Court Extends Iqrarul Hassan’s Remand by Two More Days

A judicial magistrate in Karachi extended journalist Iqrarul Hassan’s physical remand by two days on Saturday in a case accusing him of harming the state and national integrity through anti-state content on social media, according to the Express Tribune.

The judicial magistrate (East) rejected an application filed by Hassan’s lawyers and ordered the National Cyber Crime Investigation Agency (NCCIA) to present its report at the next hearing.

What the case alleges

The case against Hassan has been filed under Sections 9, 10, 20, 24 and 26-A of the Prevention of Electronic Crimes Act (PECA) 2016. According to the FIR, the journalist “through his personal social media accounts on the platforms X, Instagram and Facebook, is intentionally disseminating false, fabricated, anti-state and defamatory content with the object of instigating the general public against the state, its institutions and its functionaries.”

The FIR stated that Hassan’s posts portrayed the state, its institutions and functionaries “in a false and distorted manner” and that he “represented lawful measures as controversial with the intent to instigate and incite the general public at large against the state and the lawfully constituted authorities.”

It further said the journalist’s posts reached a substantial following “in an open, publicly accessible manner, without restriction, so as to reach and influence the public at large throughout Pakistan and abroad.”

How the case has unfolded

Feature Pakistan has followed this case from the start. Last week, the NCCIA produced Hassan before the judicial magistrate, who handed him over to the agency on a four-day physical remand. On Thursday, the District and Sessions Court East dismissed a petition challenging that remand, with the defence counsel questioning the legality of the proceedings and arguing the case concerned digital and cyber matters.

Hassan’s wife Farah Iqrar told The Express Tribune on October 12 that a group of unidentified individuals posing as NCCIA officials had taken him away from their residence in Lahore’s Defence C area late on Sunday night. She said between five and seven people, including women, demanded Hassan come outside and threatened to break down the door if he was not handed over.

Later, Punjab Information Minister Azma Bokhari said Punjab Police had not arrested Hassan and that investigations were underway, promising the family would be informed once verified information about his whereabouts became available.

Hours before the reported incident, Hassan had posted a message on X criticising the Pakistan Peoples Party and referring to Nawaz Sharif and President Asif Ali Zardari.

What happens next

The NCCIA must now present its report before the magistrate when the extended remand ends. The defence is expected to renew its challenge to the detention. The case has drawn close attention from journalist bodies and press freedom observers, who see the use of PECA against reporters as a growing pattern.
