K-P Local Government Elections Suspended Indefinitely

The K-P local government elections suspended this week will stay on hold after the Election Commission halted preparations in the remaining districts, following the federal government’s extension of the Article 140-A suspension to the whole province.

At the same time, the commission fixed February 7, 2027, for the first phase of local government elections in Punjab.

K-P local government elections suspended: what the ECP decided

The commission had earlier decided to hold local government elections in Khyber Pakhtunkhwa, except in those districts where Article 140-A had been suspended after the imposition of governor’s rule and emergency. Preparations for the exercise had also begun.

At a meeting held on Thursday, chaired by Chief Election Commissioner Sikandar Sultan Raja, the commission took up the federal government’s order, which had been issued a day earlier. Under Clause 2 of the order, the suspension of Article 140-A was extended to all remaining districts of the province, apart from those already covered.

The commission was told that Article 140-A provides for local governments in the provinces, while its second subsection assigns the Election Commission the duty of conducting their elections. It concluded that holding the polls was no longer possible, and ordered all steps taken so far to be suspended until further notice.

The order follows the emergency proclaimed on October 11 under Articles 232 and 234, after which the federal government took control of the province through the governor. PTI MPA Javed Kausar was detained for a month under 3-MPO, and opposition leaders met at Maulana Fazlur Rehman’s residence to discuss the emergency.

What the commission had decided a day earlier

The latest order reverses a decision the commission had announced only a day earlier. On Wednesday, a five-member bench had ordered local government polls to proceed in districts where delimitation had been completed, 23 districts in all, while excluding the districts covered by emergency measures. Feature Pakistan reported that decision on Wednesday.

The provincial government had sought a blanket delay, citing the law-and-order situation, the emergency and the deployment of troops under Article 245. The commission did not accept a blanket delay at that hearing, and instead drew a line between districts where delimitation was complete and those under emergency measures. The federal order issued a day later removed that distinction, by extending the suspension of Article 140-A to every remaining district.

Why Article 140-A matters

Article 140-A of the Constitution requires each province to establish a local government system and to devolve political, administrative and financial responsibility to elected local representatives. Its second subsection gives the Election Commission the duty to conduct those elections.

When the provision is suspended, the constitutional basis for holding local polls in the affected districts falls away. That is why the commission could not proceed, even though preparations had begun. The Federal Constitutional Court recently rejected a JUI-F appeal over a reserved seat.

What happens next

In Khyber Pakhtunkhwa, no date has been set. The polls will remain suspended until the suspension of Article 140-A is lifted, or the courts decide the questions before them. In Punjab, the first phase of polling will take place on February 7, 2027.

Tribune reported the commission’s decisions on Friday.

Frequently asked questions

Why were K-P local government elections suspended?

The federal government extended the suspension of Article 140-A of the Constitution to all remaining districts of Khyber Pakhtunkhwa. The Election Commission concluded that it could no longer hold the polls without that provision in force.

When will Punjab hold its local government elections?

The Election Commission has fixed February 7, 2027, for the first phase of polling in Punjab. The province sought a date after January 20, 2027, because of smog, fog, Ramazan and the availability of schoolteachers.
