The Election Commission of Pakistan has taken notice of an alleged violation of the code of conduct by Information Minister Attaullah Tarar during campaigning for the NA-77 by-poll in Gujranwala.
The electoral watchdog acted on Saturday, November 7, a day before polling in the constituency. It said media reports showed the minister had visited the constituency by helicopter and addressed a campaign event for Rashid Basheer Virk, who is contesting the seat.
Dawn reported that the commission has sought a report from the district monitoring officer and the district returning officer. It has also directed the minister to appear before the commission in person.
What the ECP said
A press release from the commission said the minister’s reported visit and address at the campaign event breached the code of conduct for the by-election.
The code bars public office holders, including federal ministers, from taking part in campaign activities. The rule is meant to stop the use of state office and official resources to tilt a contest in favour of one candidate.
The commission said it would inquire into the matter through its district officers. It also warned that the result of the constituency could be withheld until a final decision was made.
That warning carries weight. A withheld result would leave the seat undecided even after votes are counted on Sunday, until the commission settles the question of whether the code was broken.
The rule on ministers and campaigns
The bar on ministers campaigning is one of the oldest rules in Pakistan’s election code. It applies to the prime minister, federal ministers, advisers, provincial chief ministers and provincial ministers while an election is under way in a constituency.
The logic is simple. A minister who campaigns in a constituency speaks with the authority of the state behind him. The code therefore draws a line between holding office and seeking votes, and it expects ministers to stay out of campaigning until polling is over.
What happens next
The district monitoring officer and the district returning officer must now send their reports to the commission. Those reports will record what happened at the event and whether the minister’s presence amounted to campaigning under the code.
Tarar has been directed to appear before the commission in person. No date for that appearance was given in the press release.
Until the commission decides, the result of NA-77 stays at risk. The ECP said the outcome could be withheld, which means the seat would remain vacant while the inquiry runs its course.
NA-77 by-poll: the seat and the candidates
By-elections in NA-77 and Punjab Assembly constituency PP-203 (Sahiwal-VI) are scheduled for November 8. Both seats fell vacant after the deaths of PML-N lawmakers.
Polling in PP-203 will also be held on Sunday, with the Election Commission setting up 185 polling stations across that constituency.
NA-77, Gujranwala-I, fell vacant after the death of five-time MNA Chaudhry Mehmood Bashir Virk on September 11, after a prolonged illness. His son, Rashid Basheer Virk, is among the candidates contesting the seat.
The by-poll is therefore a family succession as well as a test of the PML-N’s hold on a seat it has kept for years. The ECP’s notice has now added a legal question to a contest that was already being watched closely.
Why this matters
By-elections rarely draw this level of attention from the commission a day before polling. The notice sends a message to all public office holders that the code applies even in the final hours of a campaign. Each by-election also shifts the party balance in the National Assembly, which Feature Pakistan tracks here.
For voters in NA-77, the practical effect is uncertainty. They will vote on Sunday, but they may have to wait for the commission’s decision before they know who has won.
