India Stages Mock Impeachment of Poll Chief

India’s opposition staged a mock impeachment of poll chief Gyanesh Kumar on Saturday, in a symbolic protest against a revision of voter lists that it says could unfairly benefit the ruling party. The proceedings have no constitutional or legal force, but the opposition used them to put its case against the Chief Election Commissioner in public.

Opposition parties gathered at Congress president Mallikarjun Kharge’s residence in New Delhi and re-enacted a parliamentary session. Former Lok Sabha Speaker Meira Kumar presided, while Kharge moved the symbolic motion. Rahul Gandhi told the gathering the opposition had resorted to the exercise as it had “nowhere else to go”.

“The motion we have brought forward today is aimed at safeguarding the dignity of a constitutional institution,” Kharge said. “Our intention is for the election commission to function impartially, in line with the spirit of the constitution.”

Mock impeachment of poll chief: the six charges

Kharge levelled six charges against Kumar, according to the Indian Express and The Week. He accused the chief election commissioner of conspiring to steal elections, of acting at the behest of Prime Minister Narendra Modi and Home Minister Amit Shah, and of deleting 13.2 crore voters during the Special Intensive Revision, known as SIR, of electoral rolls.

The other charges were that Kumar rewrote Form 6, the form used by first-time voters, without Parliament’s approval, seized the electoral rolls through the ECINET system, and shut out the other two election commissioners. Those claims are the opposition’s allegations. Both the Election Commission and the ruling Bharatiya Janata Party deny that the revision has been manipulated to favour the BJP.

The commission says the revision is needed to ensure accurate voter lists. Under the constitution, a chief election commissioner can only be removed through a parliamentary process requiring a special majority, and impeachment motions submitted in April were rejected by the presiding officers of both houses, according to the Indian Express.

Sonia Gandhi, Priyanka Gandhi Vadra and Rashtriya Janata Dal leader Tejashwi Yadav were among those who attended, the Indian Express reported.

What the ruling party said

Home Minister Amit Shah said the BJP was ready to hold a special session of parliament to discuss the revision. “But they (the opposition) have no intention of speaking there. They refuse to let the parliament function. Instead, they just create a ruckus,” he said.

Gandhi took a different view. “We have no other option. Every single institution is closed for us,” he said. Kharge added that the opposition had no personal enmity with Kumar.

The proceedings were first set for October 30, but were postponed a day because of heavy rain in Delhi, according to UNI and Business Standard. They were held at Kharge’s residence at 10 Rajaji Marg.

Why this protest matters, and what comes next

The mock impeachment is part of a wider opposition campaign against alleged vote theft and the SIR exercise, after weeks of street protests over the voter-roll revision.

Feature Pakistan covered the Delhi protest crackdown over the same voter-roll dispute, in which opposition supporters and youth-led campaigners challenged the revision. Dawn linked Saturday’s event to the next step in that campaign: a major opposition rally in Delhi on Sunday, backed by the youth-led Cockroach movement. Other Indian outlets described the same Sunday event as an INDIA bloc rally at Ramlila Maidan, under the slogan “Vote Bachao, Desh Bachao”, or save the vote, save the country.

What is a mock impeachment?

It is a re-enactment of a parliamentary session. It has no constitutional or legal force and cannot remove the chief election commissioner.

Who took part in the proceedings?

Former Lok Sabha Speaker Meira Kumar presided, Congress president Mallikarjun Kharge moved the motion, and leaders including Rahul Gandhi, Sonia Gandhi and Priyanka Gandhi Vadra attended.

What are the opposition’s main charges?

Kharge levelled six charges, including deleting 13.2 crore voters in the SIR exercise, rewriting Form 6, seizing rolls through ECINET, shutting out the other two commissioners, and acting at the behest of Modi and Shah. These are allegations denied by the commission and the BJP.

What happens next?

The opposition plans a rally at Ramlila Maidan in Delhi on Sunday, November 1, under the slogan “Vote Bachao, Desh Bachao”, to press its demand for Kumar’s removal and the cancellation of the SIR exercise.
